Generally, documents with legal affect are not able to be copyrighted. For instance, Congress can’t copyright a law. It’s immediately part of the public domain. Likewise, you can’t copyright a contract or a will. But, despite these rules, sometimes copyright notices still appear. For instance, UNIDROIT conventions are copyrighted. Now, in a country where UNIDROIT hasn’t been adopted, the copyright may still be valid, but everywhere else, they’re laws and can be reproduced freely.
So, what about the bar exam questions? They’re obviously not laws, but they’re part of a licensing process given affect by state laws. Does their role in a government function make the questions uncopyrightable? (Keeping in mind that this is a different question than whether it may still be an ethics violation to reproduce them.)
